The Litigation Guide

A practical, step-by-step handbook for incarcerated individuals pursuing legal claims in federal court.

About the Book

The Litigation Handbook: How to Navigate Prison Legal Systems, Assert Your Rights, and Hold Officials Accountable

The Litigation Handbook is a practical, step-by-step guide written by someone who has lived the reality of incarceration and successfully litigated from inside prison walls. Drawing on firsthand experience, the book explains how incarcerated people can recognize constitutional violations, navigate prison grievance systems, and pursue legal claims in federal court — without a lawyer. It focuses on the real barriers prisoners face, including retaliation, limited law library access, strict deadlines, and procedural traps designed to derail cases before they are heard.

The handbook walks readers through the full lifecycle of prisoner litigation, including administrative exhaustion, drafting complaints, motion practice, discovery, responding to dismissals, and appeals. It covers key legal frameworks such as Bivens actions, the Federal Tort Claims Act (FTCA), the Prison Litigation Reform Act (PLRA), and constitutional claims involving medical neglect, excessive force, and due process. Each section emphasizes clarity, organization, and strategy, showing readers how to match facts to law, cite controlling case authority, and meet court requirements even when filings must be handwritten.

More than a legal reference, The Litigation Handbook is a survival manual for self-represented litigants and jailhouse lawyers. It includes practical tips, examples, and forms designed to help readers protect their rights, preserve claims, and persist through dismissals and appeals. While not legal advice, the book empowers incarcerated individuals with the knowledge and tools needed to use the law as a means of accountability — and to refuse silence in the face of injustice.

Reviewed by Attorney’s and other legal professionals

In developing this guide, the author sought guidance from a licensed Maryland attorney and law librarian with judicial clerkship experience. Their insight helped ensure that the legal explanations, procedural steps, and strategic recommendations in this guide reflect both real-world practice and the expectations of federal courts.

In addition, this guide has been reviewed and edited by attorneys and other legal professionals with experience in civil rights litigation, federal procedure, and prisoner advocacy. Their collective review has helped strengthen the accuracy, clarity, and practical usefulness of the material presented.

While this handbook is not legal advice, it benefits from the perspective of practitioners who have supported litigants, interpreted court rules, and worked closely with judges, providing readers with a reliable and informed foundation for understanding the legal process.
